Illinois Perinatal HIV Prevention Act

The Illinois Perinatal HIV Prevention Act (Public Law 95-702) mandates the following:

  1. HIV counseling of all pregnant women
  2. Providers institute opt-out HIV testing in each pregnancy for all pregnant women
  3. HIV test results be documented in the maternal and newborn medical charts
  4. Rapid HIV tests be recommended on labor and delivery to women without a documented HIV status
  5. Mandatory HIV testing of newborns as soon as medically possible after birth if the mother’s HIV status is unknown
  6. Hospitals report preliminarily HIV positive women and/or infants to the 24/7 Illinois Perinatal HIV Hotline within 24 hours
  7. Hospitals submit monthly aggregate statistics that include the number of infected women who present with known HIV status, the number of pregnant women rapidly tested for HIV in L&D, the number of newborn infants rapidly tested for HIV, the number of preliminarily positive pregnant women and preliminarily HIV-exposed newborn infants identified and other information determined necessary
  8. Hospitals report cases of perinatal HIV exposure of newborns
